LEASE – PRICES

The lease is carried out in the name and in favour of the property’s owner with the exclusive and sole object of tourist tenancy and according to the rates indicated in the price list of SICILY DISCOVERY LTD.

According to Italian national and regional laws, the denomination of Private Structure derives from the fact that the owner rents the property as a private individual and not as a company or accommodation facility with special hotel licence or similar. The substantial difference between a private structure and accommodation facilities is the absence of additional services provided by the owner during the guests’ stay. These services can be supplied only from third parties and directly paid by the guest on site

Therefore the private structure is available on Accommodation Only basis. Furthermore, in the absence of guests, the private structures are often occupied by the owner and so the rent is understood as occasional and not continuous and especially in a non-business form. Being private homes for holiday use they do not have a standard or category recognized internationally but reflect the local traditions and personal taste of the owners in the architecture and furnishings so that it is normal – as it is normal in the houses where we usually live – that there can be minor flaws.

All of the houses are furnished with fitted kitchen or with equipped kitchen corner (crockery, pots, fridge). In the description of each single accommodation unit it is stated which electrical household appliances (TV, washing machine, dish-washer, etc.) are available. Please, notice that the accommodations mostly belong to different private owners and therefore have their own different features. Because of this it is better to point clearly out any particular requirement of yours at the very same moment of the reservation and in any case, these specific requirements must be pointed out before your acceptance of the contract and put down in words in the proper “booking form.

The beds signed by the symbol “+“ must be considered as additional beds and at any rate less comfortable either for distribution and privacy than the usual sleeps (e.g. sofa-beds or beds located in the living room). The tenancy rates inclusive of: water, electricity, gas consumptions bed linen and towels; possible expenses for the heating and/or for the air-conditioning (if available);

All these possible “extra” charges are meant to be payable locally. Please note that local tourist taxes are not included in the price and shall be borne by the customer and paid directly to the owner or administrator on site.

BOOKINGS

In order to book please, send an e-mail, phone, fax or personally apply either to SICILY DISCOVERY LTD or to the travel agencies. The booking is dependent to the previous confirmation of the availability of the chosen lodging on the part of SICILY DISCOVERY LTD . Within 72,48 or 24 hours(the duration depends on the period when you book) must be forwarded to SICILY DISCOVERY LTD together with an evident proof (copy of the bank transfer sent via e-mail or fax) of your first payment equal to a 30% deposit of the whole lease price. You shall receive through a mail– sent on the part of SICILY DISCOVERY LTD – a complete “statement of account” summing up all the amounts of your reservation: the one already down paid (deposit) and the one still to down pay (balance).

Once your balance is received SICILY DISCOVERY LTD will send you an “accommodation voucher” of its own providing you with all the useful information about the delivery of the keys and the travel directions to reach the reserved accommodation itself. The contract between the two parts will be considered regularly active and already definitive with your down payment of the deposit. Should you fail to down pay the deposit amount within 3 days from your reception of the written and official “booking confirmation” sent on the part of SICILY DISCOVERY LTD, your booking itself will be automatically cancelled.

LENGTH OF TENANCY – ARRIVAL TIME

Arrival time is between 16.00 and 19.00 hours. We ask clients to communicate their arrival time at least a week in advance so that the owner or his representative can be on site to welcome the client and facilitate his admission.
In the event the arrival is later in the evening and after 08.00 p.m., Sicily Discovery will facilitate the arrival of the clients at the reserved property, trusting in the collaboration of the owners who may require an extra charge for a late check-in, which cost will be assessed each time.

Any changes regarding the date and time of arrival must be notified to Sicily Discovery via e-mail or by telephone to the numbers on the final travel documentation (owner, Sicily Discovery office or Customer Service) in order to better organize the check-in. If the owner will not be informed about a possible delay notified on the arrival day and is not able to accept the “late check – in”, the client will bear the cost of an overnight stay at a different structure to that booked with Sicily Discovery, without requiring anything from Sicily Discovery or the owner, who will in any case do their best to satisfy the client.

Departure from the property will be in the morning before 10.00 hours, allowing access to the owner to check the state of the property. In the event that guests check-out before 08.00 hours the owners, at their discretion, may require an extra charge which will be indicated at the time of the request for early check-out.
The departure time, however, must always be communicated at least 12 hours beforehand to the owner or property manager.

NUMBER OF GUESTS

At the time of booking clients will be required to enter the names and ages of the people staying in the property in the presence notification form, which can be viewed and filled in via the Reserved Area on the website for notifying attendance to the competent authorities.

Only the people whose name is indicated in the “accommodation voucher” of SICILY DISCOVERY LTD will be allowed to occupy the property. Any possible substitution of people during the term of the stay will be permitted only if previously agreed with SICILY DISCOVERY LTD. The number of guests (adults + children) cannot be bigger than the number you stated at the moment of your reservation and at any rate cannot outnumber the sleeping capacity indicated in the description of the accommodation unit present on the internet site www.SICILYDISCOVERY.com. In the total number of people in party only one child no older than 3 years will not be counted. The key-holder may forbid entrance into the accommodation to those people in excess.

FORMALITIES AT THE ARRIVAL – SAFETY DEPOSIT

Please, 2-3 days before your arrival date phone, fax or e-mail SICILY DISCOVERY LTD in order to advise about your estimated arrival time and to arrange and/or confirm the modalities concerning the delivery of the reserved house. At arrival the holiday-maker has to produce the above mentioned “accommodation voucher” together with a personal identification paper and leave a safety deposit , equal to the amount indicated in the description of the accommodation unit. The key-holder – might it be the tourist-real estate agent’s office SICILY DISCOVERY LTD, the property’s owner personally or one person in charge – can refuse entrance into the accommodation to the holiday-maker if this last does not

leave a safety deposit at arrival. This very same safety deposit will be refunded at the end of stay – after the inventory check has been carried out contextually to the redelivery of the lodging to the key-holder – and upon deduction of any possible damage caused to the lodging itself.

CLEANING AND EXTERNAL MAINTENANCE

Normal housecleaning isn’t included in the weekly price unless otherwise specified in the house information sheet published on the website and in the catalogue. The housecleaning does not include cleaning the kitchen and waste disposal.
Properties must be returned in good hygienic conditions in all parts and accessories. If not the client will be required to pay the owner or his representative the cost needed for cleaning. It is the responsibility of the client to take care of waste disposal

If the guests do not dispose of waste from the property the owner or his representative may ask for an additional charge for this service. The kitchen must be left clean and tidy. If, for any reason, including
time, guests cannot clean the kitchen and the furnishings/fittings before their departure, the owner will be entitled to request an extra charge for it to be cleaned.

Besides, the key-holder – might it be the tourist-real estate agent’s office SICILY DISCOVERY LTD, the property’s owner personally or one person in charge– may have free access to the property in order to perform the necessary operations of maintenance (garden, swimming pool and so on).
It is understood that the owners will always provide prior notice and will require the presence of the guests themselves, it being understood that where guests cannot be present during the work progress, the owners or their representatives can however enter the houses, if necessary, to carry out any repairs.

CANCELLATIONS – CHANGES

In case of cancellation – confirmed in writing – of his/her reservation the holiday-maker has the right to be reimbursed of the tenancy price, net of the following penalties:
• 100% of the tenancy price if the cancellation is communicated to SICILY DISCOVERY LTD at least 30 days before the beginning date of the stay;

• 70% of the tenancy price if the cancellation is communicated to SICILY DISCOVERY LTD in the running of the 30 days preceding the beginning date of the stay.

• 50% of the tenancy price if the cancellation is communicated to SICILY DISCOVERY LTD in the running of the 7 days preceding the beginning date of the stay.

The renouncing customer may let himself/herself be substituted by other person within the last 4 days preceding the beginning date of the stay, upon written notice previously forwarded to SICILY DISCOVERY LTD

Changes of term or accommodation are considered as cancellations and therefore – in such cases – the pertinent penalties will be enforced anyway. 24 hours elapsed from the failed arrival without any communication sent to SICILY DISCOVERY LTD the lease will be automatically rescinded and SICILY DISCOVERY LTD will give the availability of the lodging back to the property’s owner with no obligation at its own charge.

ADDITIONAL SERVICES

Whilst we are happy to assist clients when possible, with certain additional services arranged (payable locally) please note that we do so as your agent and do not enter into any contract with you for these.
We cannot guarantee that any such service will be provided (even where confirmed) and will not be liable if it isn’t. Your contract will be with the supplier of the service concerned, which will be subject to the supplier’s own terms and conditions. Such services included the provision of rented telephones, rented router, cooking services, rent bicycle,rent boat and car hire, tours etc.

If things go wrong, our local agent or representative or the house owner will intervene with the supplier ti try to find a solution.

RESPONSIBILITIES OF SICILY DISCOVERY LTD

Should, owing to reasons not within or circumstances beyond its own control, SICILY DISCOVERY LTD not be able to place the reserved property at the holiday-maker’s disposal, it will be consequently allotted him – upon his/her approval – a property with similar characteristics.
In the event that the price of the new property is less, Sicily Discovery Ltd will arrange for a refund in favour of the client equal to the difference whilst in the event that the price of the new property exceeds by 10% the sum paid by the client, the client, by accepting the proposed property, will be required to pay the difference of the higher price.

If the parties fail to agree to the substitution of the property, after receiving the written cancellation of the contract on the part of the client, Sicily Discovery Ltd will refund the amount paid less the registration fee. In no case will Sicily Discovery Ltd pay hotel or other bills.

In the case that what has been written above could not be possible SICILY DISCOVERY LTD will be compelled to cancel the booking and refund the entire down paid sum to the client who – from that moment on – will have no right to any further indemnity.

Sicily Discovery Ltd cannot be held responsible in the event that the client, who has correctly reviewed the website, does not find, on arrival, the property to be to his liking since the company has endeavoured to provide with photographs and detailed information and the best description possible of the structure.

Furthermore, no refund will be recognized to clients who leave the structure on the request of the owners due to lack of notification relative to persons in excess or to the presence of animals (the number of persons in excess and the presence of animals must always be notified to Sicily Discovery Ltd and accepted by them in agreement with the owners) or in the absence of payment of the security deposit requested on arrival.

No form of refund will be given clients who, in the case of misunderstandings or problems, leave the property without prior written notice to Sicily Discovery Ltd or to clients who decide to leave the reserved property early, in the absence of valid reasons or serious inconvenience and without having given Sicily Discovery Ltd written explanation and justification in advance or who have not properly consulted the website and have found conditions not appropriate to them or who have left the property without giving the representative of Sicily Discovery Ltd the chance to verify the reasons of the complaint.

Sicily Discovery Ltd does not recognize as grounds for complaint weather conditions, insect bites or lack of electricity, gas or water.

Sicily Discovery Ltd declines any liability for any inconvenience caused by third parties or for external events not directly attributable to the owner of the structure or his collaborators such as, for example, weather conditions, local fauna, seasonal phenomena, maintenance of public roads or renovations of buildings and the like in the vicinity of the properties rented by Sicily Discovery Ltd.
The owners and Sicily Discovery Ltd decline any liability for personal and/or valuable items left unattended inside the property. Sicily Discovery Ltd and the owners are also not liable for any inconvenience or damage caused by third parties or external events not directly attributable to the property and not under the direct control of the owner himself.

PETS

Each property information sheet indicates whether pets are allowed. At the time of booking the client is required to communicate any pets he will be bringing with him, indicating the number and size. The owner can refuse access to clients bring pets without having notified it at the time of booking or can refuse to accept pets when the number seems excessive for the property.Charge for extra clearing will be requie on site.

RECLAIMS

Each accommodation proposed has been previously visited and checked with accuracy by SICILY DISCOVERY LTD itself which – for this very reason – declines all responsibilities for whatever modification introduced to the lodging by the property’s owner without informing SICILY DISCOVERY LTD in advance. At arrival the client has to verify the good conditions of the accommodation, the inventory, the well-functioning of the electrical household appliances and make possible complaints within 24 hours.
The repair for possible damages caused or happened in the course of the stay will be at the customer’s expanse. SICILY DISCOVERY LTD is however at your disposal to solve possible problems. Of course, to make that possible it is indispensable that your complaints are put forward in good time. At any rate, for all those claims carried out after the end of stay, the client will have no right to any kind of compensation.

TREATMENT OF PERSONAL DATA

Personal data and other elements acquired by our Agency during the course of the assignment, will be subject to secrecy and will be treated in compliance with the privacy and the rights of the person through the systematic application on our part of appropriate measures of protection and guarantee prepared both for paper and electronic processing of data and measured to the specificity of the data itself (simple personal data or sensitive or judicial data). Pursuant to the effects of the Legislative Decree 196/03 we inform the client that his personal data will be processed only for purposes determined by the contract for such purposes (including for accounting and administrative purposes). Please also be advised that such data could be used for commercial and promotional activities pertaining to the services provided by our Agency, for this last use consent for treatment is required. The absence of the Client’s consent will not allow our Company to use the personal data to conduct commercial activities.
